1. Agreement to Terms

The mobile application CaribShorts (the "App"), the website available at caribshorts.com (the "Website") and content available via the App and the Website ("Content") are provided by CaribShorts ("we", "us", "our", or the "Company").

These Terms of Use and Service ("Terms") are an agreement between you as a user ("User") of the Service and us. Please read these Terms carefully before using the Service.

By downloading, installing, or otherwise accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by all of these Terms, including CaribShorts's Privacy Policy. If you do not agree with these Terms, you must discontinue use immediately.

We reserve the right to modify these Terms at any time. We will alert you about changes by updating the "Last updated" date. Your continued use after changes constitutes acceptance.

2. Use of Service

CaribShorts is an online streaming platform that provides access to Caribbean short-form video content created by Caribbean creators and others.

To use the Service, you shall be at least 18 years old (or of the reciprocal age of majority in your jurisdiction) and able to form legally binding contracts. We do not knowingly collect personal information from children under 18 years of age.

By agreeing to these Terms, you represent and warrant that: (a) you are at least 18 years of age; (b) you have not previously been suspended or removed from the Service; and (c) your use of the Service is in compliance with all applicable laws and regulations.

By purchasing a subscription or coins, you will receive access to premium content on the platform. Coins can also be purchased separately in coin bundles.

3. Accounts and Registration

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate.

You are responsible for safeguarding your account credentials. You agree not to share your password with third parties. You are fully responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use.

We reserve the right to suspend or terminate your account at any time, with or without cause and with or without notice.

4. Payments, Subscriptions, and Coins

4.1. Payments

Certain features of the Service require payment. You agree to provide valid payment information and authorize us to charge your payment method for all purchases made through your account.

4.2. Coin System

Our platform uses a coin-based system for content access. You can purchase coins through coin bundles or receive them as part of a VIP subscription. Coins are used to unlock premium episodes of series on the platform.

4.3. VIP Subscriptions

VIP subscriptions provide enhanced access to the platform, including bonus coins. Subscriptions auto-renew at the end of each billing period unless cancelled before the renewal date.

4.4. Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You will retain access to VIP features until the end of the paid period.

4.5. Refunds

All purchases are final. We generally do not provide refunds. However, refund requests may be considered on a case-by-case basis. For refund inquiries, contact support@caribshorts.com.

5. Creator Terms

5.1. Creator Accounts

Approved creators may upload short-form video series to the platform. All uploaded content must comply with our content guidelines and applicable laws.

5.2. Revenue Sharing

Creators earn a share of revenue generated when viewers unlock their premium episodes using coins. The current default creator share is up to 85% of the coin value, with the platform retaining the remaining percentage as a service fee. The exact commission percentage is configurable and displayed in the creator dashboard.

5.3. Free Episodes

Each series must have a minimum of 3 free episodes. Creators may set additional episodes as free at their discretion. Creators also set the coin price for premium episodes.

5.4. Content Approval

All uploaded content is subject to review and approval by CaribShorts. We reserve the right to reject, remove, or modify any content at our sole discretion.

5.5. Intellectual Property

Creators retain ownership of their original content. By uploading content to CaribShorts, you grant us a non-exclusive, worldwide, royalty-free license to display, distribute, and promote your content on our platform.

6. Prohibited Activities

As a User, you agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Upload or distribute content that infringes intellectual property rights
  • Upload content containing explicit, harmful, or objectionable material
  • Systematically retrieve data from the Service to create databases without permission
  • Circumvent security features or access restrictions
  • Use automated systems (bots, scrapers) to access the Service
  • Interfere with or disrupt the Service or connected networks
  • Decompile, reverse engineer, or disassemble any part of the Service
  • Distribute viruses, malware, or other harmful software
  • Impersonate another person or misrepresent your affiliation
  • Use the Service in any manner inconsistent with applicable laws

7. Content on the Service

7.1. Proprietary Rights

The Service and its original content (excluding user-generated content), features, and functionality are owned by CaribShorts and are protected by international copyright, trademark, and other intellectual property laws.

7.2. User Content License

By uploading content to the Service, you grant CaribShorts a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, distribute, and display such content in connection with the Service. You represent that you own or have the necessary rights to grant this license.

8. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.

All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Disclaimer

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Limitation of Liability

IN NO EVENT SHALL CARIBSHORTS, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

11. Governing Law

These Terms shall be governed and construed in accordance with applicable laws, without regard to conflict of law provisions.
