If you wish to exercise your rights under the Digital Millennium Copyright Act of 1998 (17 U.S.C. §512, as amended) please follow the procedure described below.

Procedure for Reporting Claimed Infringement

If you believe that any content made available on or through the Service infringes your intellectual property right, please promptly send a written "Notification of Claimed Infringement" containing the following information to the designated agent identified below. CaribShorts may share your Notification of Claimed Infringement with the User that is a possible infringer, and you consent to making such disclosure by CaribShorts. Your communication must include substantially the following:

  • An electronic or physical signature of a person authorized to act on behalf of the owner of the material(s) that is allegedly infringed
  • A description of the material(s) allegedly being infringed
  • A description of the specific material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit CaribShorts to locate the material on the Service (such as a URL to that material)
  • Your name, address, email address, and telephone number
  • A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright or other intellectual property owner, its agent, or the law
  • Under penalty of perjury, a statement that the information in the Notification of Claimed Infringement is accurate and truthful, and that you are the owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed

You should consult with your own lawyer and/or review applicable law regarding copyright or other intellectual property infringement to confirm your obligations to provide a valid Notification of Claimed Infringement.

Counter-Notification

If you believe that content you posted was wrongly removed or disabled as a result of a Notification of Claimed Infringement, you may send a counter-notification to our designated agent. Your counter-notification must include:

  • Your physical or electronic signature
  • Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the applicable court

False Notifications

CaribShorts reserves the right to seek damages from any party that submits a false Notification of Claimed Infringement or Counter-Notification in violation of the law, as provided for by applicable law.

Repeat Infringers

CaribShorts will promptly terminate without notice the accounts of Users that are determined by CaribShorts to be "Repeat Infringers." A Repeat Infringer is a User who has been notified of infringing activity or has had User Content removed from the Service at least twice.
